
The ongoing discrimination case

The Applicant had filed an originating application with the Superior Court alleging discrimination by the Respondent (the University of Sherbrooke). The discrimination in question was based on the Applicant's ethnic origin in the context of a residence for new residents with international graduates ("DHCEU") offered by the Respondent (the University of Sherbrooke), in contravention of section 10 of the Charter of Human Rights and Freedoms.
The Defendant, in turn, appealed to the Superior Court to have the Plaintiff's claim declared inadmissible and dismissed on the grounds that the claim was based on the alleged abuse of proceedings by the Defendant and on the fact that the originating claim was unfounded in law even taking the facts to be true.
On October 7, 2020, Superior Court Judge GAETAN DUMAS issued a decision referring the case back to the trial judge who will have to decide whether the Plaintiff was a victim of discrimination and, if so, decide on the damages suffered by him.
